A recent hypothesis in empirical brain research on language is that the fundamental difference between animal and human communication systems is captured by the distinction between finite-state and more complex phrase-structure grammars, such as context-free and context-sensitive grammars. However, the relevance of this distinction for the study of language as a neurobiological system has been questioned and it has been suggested that a more relevant and partly analogous distinction is that between non-adjacent and adjacent dependencies. Online memory resources are central (...) to the processing of non-adjacent dependencies as information has to be maintained across intervening material. One proposal is that an external memory device in the form of a limited push-down stack is used to process non-adjacent dependencies. We tested this hypothesis in an artificial grammar learning paradigm where subjects acquired non-adjacent dependencies implicitly. Generally, we found no qualitative differences between the acquisition of non-adjacent dependencies and adjacent dependencies. This suggests that although the acquisition of non-adjacent dependencies requires more exposure to the acquisition material, it utilizes the same mechanisms used for acquiring adjacent dependencies. We challenge the push-down stack model further by testing its processing predictions for nested and crossed multiple non-adjacent dependencies. The push-down stack model is partly supported by the results, and we suggest that stack-like properties are some among many natural properties characterizing the underlying neurophysiological mechanisms that implement the online memory resources used in language and structured sequence processing. The COPE Inventory is the most frequently used measure of coping; yet previous studies examining its factor structure yielded mixed results. The purpose of the current study, therefore, was to validate the factor structure of the COPE Inventory in a representative sample of over 2,000 adults in Slovakia. Our second goal was to evaluate the external validity of the COPE inventory, which has not been done before. Firstly, we performed the exploratory factor analysis with half of the sample. Subsequently, we (...) performed the confirmatory factor analysis with the second half of the sample. Both factor analyses with 15 factor solutions showed excellent fit with the data. Additionally, we performed a hierarchical factor analysis with fifteen first-order factors and three second-order factors which showed good fit with the data. Moreover, the COPE Inventory’s external validity was evaluated using consensual qualitative research analysis on data collected by in-depth interviews. Categories of coping created using CQR corresponded with all COPE first-order factors. Moreover, we identified two additional first-order factors that were not present in the COPE Inventory: self-care and care for others. Our study shows that the Slovak translation of the COPE Inventory is a reliable, externally valid, and well-structured instrument for measuring coping in the Slovak population. (shrink)

Assessing maturity is one of the main ethical challenges for bioethics. It is even more complex when it comes to adolescents, as they are still in their maturing process. Three difficulties emerge: a conceptual difficulty as maturity is related to autonomy, competence and capacity; a methodological difficulty regarding which indicators should be used to assess it; and a practical difficulty in how to properly deal with it, as it is not easy to respect a maturity that only for a little (...) while now is being recognized and promoted. This paper begins by answering the question of why it is important to assess and promote maturity. Then, a chronology will be offered of the evolution of maturity attribution to minors as well as of the main variables that have been defined to asses it. Finally, some concepts will be clarified in order to develop an agglutinating proposal on indicators, requirements and conditioning factors of mature decision-making processes. (shrink)

Studies in economic decision-making have demonstrated that individuals appreciate social values supporting equity and disapprove unfairness when distributing goods between two or more parties. However, this seems to critically depend on psychological mechanisms partly pertaining to the ingroup–outgroup distinction. Little is known as to what extent economic bargaining can be manipulated by means of psychological interventions such has hypnosis. Here we show that a hypnotic ingroup versus outgroup suggestion impacts the tolerance of unfairness in an Ultimatum Game. Specifically, the ingroup (...) suggestion was associated with significantly greater acceptance rates of unfair offers than the outgroup suggestion, whereas hypnosis alone exerted only small effects on unfairness tolerance. These findings indicate that psychological interventions such as hypnotic suggestion can contribute to ingroup favoritism and outgroup rejection. (shrink)

In spite of our good intentions and explicit egalitarian convictions, we habitually disfavor the underprivileged. The rapidly growing literature on implicit bias – unconscious, automatic tendencies to associate negative traits with members of particular social groups – points towards explanations of this dissonance, although rarely towards generalizable solutions. In a recent paper, Jennifer Saul draws attention to the alarming epistemological problems that implicit bias carries with it; since our judgments about each other are likely influenced by implicit bias, we have (...) good reason to doubt their veracity. In this paper we explore a novel way to come to terms with the epistemological problem as it manifests itself in ranking situations, i.e. how we can know that the way in which we have ranked a group of people for a certain position, reflects their actual competence. On our approach, rather than attempting to make people less biased, we suggest that biased behavior can sometimes be corrected after the fact. In particular, the veracity of rankings can sometimes be improved by modifying the rankings directly. We investigate three methods that modify biased rankings, and argue that the last of these solves the epistemological problem that we are concerned with. (shrink)

This article examines Grotius’ lifelong support for Dutch expansion overseas. As noted in other publications of mine, Grotius cooperated closely with the directors of the Dutch East India Company (VOC) in the years 1604–1615. Right up to his arrest for high treason in August 1618, he contributed towards Dutch government discussions about the establishment of a West India Company (WIC). Three years of imprisonment at Loevestein Castle and, following his escape, long years of exile could not weaken his dedication to (...) the cause. His relatives in Holland, in particular his brother Willem de Groot and his brother-in-law Nicolaas van Reigersberch, kept him up-to-date on the fortunes of the VOC and WIC. His expertise on maritime affairs was in high demand. For example, Cardinal Richelieu invited him in November 1626 to become actively involved in the establishment of a French East India Company. As itinerant ideologue of empire, Grotius sought to further his own career and those of his nearest family members, without damaging the interests of the United Provinces. Through Willem de Groot and Nicolaas van Reigersberch, he provided informal advice on Dutch imperial policy to the VOC directors and government officials in The Hague. He was rewarded with the appointment of his brother and his second son, Pieter de Groot, as VOC lawyers (ordinaris advocaten) in 1639 and 1644, respectively. They served as his proxies in diplomatic disputes involving the VOC, the States General and the Portuguese ambassador in autumn 1644, when Pieter and Willem de Groot wrote a defense of VOC claims to the cinnamon-producing areas of Ceylon (modern-day Sri Lanka), liberally citing De Jure Belli ac Pacis. Grotius’ vision of empire hardly changed in the course of 40 years. In his view, the Dutch had gone to the Indies as merchants, not conquerors, and should regulate themselves according to natural law and the law of nations. Thus he contributed to the creation of two political orders, one for Europe and one for the Indies. European diplomatic relations counted for little beyond the Line. VOC and WIC officials could act as judges and executioners in their own cause, without reference to indigenous rulers, other colonial powers, or even the political authorities back home. (shrink)

Prior to any research data collection a proposal outlining methods and protocols is required to undergo ethical scrutiny. The issues surrounding a research ethics review process within sport and exercise science departments are not dissimilar to other subject areas. In particular, the ethical review process may be unclear to the researcher and can either present a difficult and time-consuming challenge or be merely perceived as a tick-box exercise. The aim of this study was to explore and compare research ethics processes (...) and decisions within sport and exercise science departments and institutions across the UK. Participants were asked to provide decisions and justification of those decisions on ten typical sports and exercise science proposals. Results found that all respondents cited evidence of informed consent and subject information sheets, detailed methodology and data protection procedures as highly important across all scenarios. Additionally it was found that similar processes occur regarding research ethical scrutiny and similar decisions are made at the departmental level. However, confidence fluctuates for individuals when reviewing in non-specialist subject areas and qualitative data collected calls for more research ethics training. (shrink)

The COVID-19 pandemic poses a health threat that has dominated media coverage. However, not much is known about individual media use to acquire knowledge about COVID-19. To address this open research question, this study investigated how the perceived threat is linked to media use and how media use is associated with perceived and actual knowledge about COVID-19. In a German online survey conducted between April 16 and April 27, 2020, N = 952 participants provided information on their perceived threat and (...) media use to inform themselves about COVID-19. In this process, they indicated how well they were informed about COVID-19 and subsequently completed a COVID-19 knowledge test. Results indicated that individuals who felt more threatened by COVID-19 used media more often to inform themselves but focused on fewer different media channels. Further, frequent media use was associated with higher perceived knowledge, but not with higher actual knowledge about COVID-19, reflecting an illusion of knowledge. Additionally, using fewer media channels was linked to higher perceived and actual knowledge. Finally, explorative analyses on the use of different media channels revealed that an illusion of knowledge emerged for using social media, public television, and newspapers. Potential explanations for the findings and implications for future research are discussed. (shrink)

The possible Stoic origins of the natural rights and natural law theories of the Dutch jurist Hugo Grotius has been a subject of scholarly debate in recent years. Yet discussions about Grotian sociability tend to focus exclusively on the meaning of appetitus societatis in De Jure Praedae and De Jure Belli ac Pacis , with little reference to the historical context. Insufficient consideration has been given to the intended audience of these works, Grotius’ purpose in writing them, and the possible (...) correlation between his overarching argument and his working methods. This article examines Grotius’ use and abuse of Seneca's philosophical works in De Jure Praedae, commissioned by the directors of the Dutch East India Company in autumn 1604.The brutal murder of Sebald de Weert on the island of Ceylon in June 1603 is analyzed from a Stoic perspective in Chapter 15 of De Jure Praedae. Following his refusal to hand over Portuguese prisoners, De Weert and his crew were butchered on the beach of Batticaloa by Wilama Dharma Suriya, the ruler of the island's interior. Grotius blamed the victim. VOC commanders in monsoon Asia should suppress any residual loyalty which they might feel towards Christendom. It was imperative to conclude alliances with native rulers against the Iberian colonial powers, regardless of the rulers’ faith or their horrific treatment of prisoners. As Grotius noted in Chapter 8 of De Jure Praedae, Seneca distinguished between “two kinds of commonwealth, the world state and the city state.” Spanish and Portuguese violations of the natural law – freedom of trade and navigation in particular – deserved condign punishment for the sake of both the fellowship of mankind and, naturally, the VOC and Dutch Republic.In assessing the uses of Stoicism in De Jure Praedae, much can be learned from the physical characteristics of Ms. BPL 917 in Leiden University Library, its sole surviving manuscript copy. Seneca's philosophical works are not cited at all in the original text of Ms. BPL 917, which Grotius copied out in 1604–1605. Instead, quotations from De Ira, De Clementia and De Beneficiis appear in the top and bottom margins of folio-pages or on inserted sheets of paper, which can be dated to 1607–1608. These quotations serve to flesh out an existing argument about the VOC's just war in the East Indies. A case in point is the heavily rewritten Chapter 2. Grotius added quotations from De Clementia at the same time as he reformulated two natural laws on f. 8–9, a folio sheet inserted in or after January 1607. This was no coincidence. Revenging the past misdeeds of the Portuguese, which Grotius had described in great detail in Chapter 11, could no longer be considered the main or only priority of the VOC. Instead, Grotius contended on f. 8–9 that “evil deeds must be corrected” so as to achieve, in Seneca's words, “universal security.” Acting as a kind of global police force, the VOC should punish transgressors of the natural law on account of “that world community” envisioned by the Stoics. The practical consequences were felt during the Twelve Years Truce . Despite a cessation of arms in Europe, the VOC continued to engage in hostilities in the East Indies. The author of De Jure Praedae supported the Company on this. Like Cicero before him, he had successfully harnessed the Stoa to the cause of empire. (shrink)

“Research assistant” is a term used to describe student researchers across a variety of contexts and encompasses a wide array of duties, rewards, and costs. As critical/qualitative scholars situated in a discipline that rarely offers funded research assistantships to graduate students, we explore how we have engaged in faculty-student research in one particularly understudied context: the independent study. Using narrative writing and reflection within a framework of collaborative autoethnography, the first three authors reflect as three “generations” of protégés who were (...) each mentored through independent studies during their MA programs by the fourth author. We explore the environmental context, mentor facets, and protégé facets that highlight the light and shadow, or successes and struggles, of our mentoring relationships. Reflecting on our own experiences of collaborative research through independent studies, we suggest a model of feminist research mentorship that may be enacted across disciplines. (shrink)

It is often acknowledged that public policies can constrain people's procreative opportunities, in some cases even infringing their procreative rights. However, a topic that is not often discussed is how the procreative choices of one generation can affect the procreative opportunities of later generations. In this article, we argue that the demographic fact that childbearing above the replacement fertility level is eventually unsustainable supports two constraints on universal procreation rights: a compossibility constraint and an egalitarian constraint. We explore the implications (...) of these two constraints and suggest that there are reasons to think of procreative opportunity as a finite resource that can be distributed more or less equally across generations. We also briefly discuss possible ways of meeting demands of intergenerational justice with respect to procreative opportunity. (shrink)

BackgroundThe UN Convention on the Rights of Persons with Disabilities, and the reformed guardianship law in Germany, require that persons with a disability, including people with dementia in Alzheimer’s disease (PwAD), are supported in making self-determined decisions. This support is achieved through communication. While content-related communication is a deficit of PwAD, relational aspects of communication are a resource. Research in supported decision-making (SDM) has investigated the effectiveness of different content-related support strategies for PwAD but has only succeeded in improving understanding, (...) which, although one criterion of capacity to consent, is not sufficient to ensure overall capacity to consent. The aim of the ‘spatial intervention study’ of the DECIDE project is to examine an innovative resource-oriented SDM approach that focuses on relational aspects. We hypothesise that talking to PwAD in their familiar home setting (as opposed to a clinical setting) will reduce the complexity of the decision-making process and enhance overall capacity to consent. MethodsPeople with a suspected or confirmed diagnosis of dementia in Alzheimer’s disease will be recruited from two memory clinics (N = 80). We will use a randomised crossover design to investigate the intervention effect of the decision-making place on capacity to consent. Besides reasoning capacity, which is part of overall capacity to consent and will be the primary outcome, various secondary outcomes (e.g., other aspects of capacity to consent, subjective task complexity, decisional conflict) and suspected moderating or mediating variables (e.g., meaning of home, demographic characteristics) will be assessed.DiscussionThe results of the study will be used to develop a new SDM strategy that is based on relational resources for PwAD. If a change in location achieves the anticipated improvement in capacity to consent, future research should focus on implementing this SDM strategy in a cost-effective manner in clinical practice.Trial registration: DRKS00030799. Harmony has become a major challenge for modern governance in the twenty-first century because of the multi-religious, multi-racial and multi-ethnic character of our increasingly globalized societies. Governments all over the world are facing growing pressure to integrate the many diverse elements and subcultures which make up modern pluralistic societies. This book examines the idea of harmony, and its place in politics and governance, both in theory and practice, in Asia, the West and elsewhere. It explores and analyses the meanings, mechanisms, (...) dimensions and methodologies of harmony as a normative political ideal in both Western and Asian philosophical traditions. The book argues that in Western political thought - which sees politics as primarily concerned with resolving social conflicts and protecting individual rights - the concept of harmony has often been neglected. In contrast, since earliest times harmony or ‘he’ has been a profound theme in Confucian thought, and current leaders of many East Asian governments, and the Chinese government, have explicitly declared that the realisation of a harmonious society is their aim. The book also assesses how harmony is pursued, jeopardized or deformed in the real world of politics, based upon empirical analysis of a variety of different cultural, social and political contexts, including: China, Hong Kong, Singapore, Malaysia, Singapore, Vietnam, Denmark, Latin America and the Scandinavian countries. It shows how harmony as an organizing concept can help to promote new thinking in governance, and overcome problems of modern-day governance like distrust, adversarial conflicts, hyper-individualism, coercive state intervention, and free-market alienation. It also discusses the potential problems posed by the pursuit of harmony, in particular in the grave threat of totalitarianism, and considers how these risks could best be mitigated. (shrink)

Emotion-Focused Training for Emotion Coaching is based on Emotion-focused Therapy findings and was developed to help participants deepen their emotional skills. The goal was to examine the efficacy of a 12-week EFT-EC group program the level of emotion intelligence, self-compassion and self-criticism in a student population. A quasi-experiment with no control group was conducted with pre- and post-measurements using The Self-compassion scale, the Forms of Self-Criticising/attacking & Self-Reassuring Scale, and the Trait Emotional Intelligence Questionnaire – short form. The EFT-EC participants (...) were128 students. The EFT-EC intervention had a significant effect on self-criticism and self-control latent scores as reported at post-measurement. The structural equation model with latent variables was not an adequate fit for the rest of the subscales. These results are promising and suggest that interventions intended to enhance emotion skills can also reduce self-criticism even when not directly addressing it. (shrink)

In this exploratory research study, we developed an instrument to investigate people’s confidence in safeguarding measures [Confidence in Safeguards Scale ] and we adapted an instrument measuring perceived risk of coronavirus [perceived risk of coronavirus scale ] that was originally based on a perceived risk of HIV measure. We then explored the effect of public confidence in safeguarding measures designed to halt the spread of the coronavirus on perceived risk, controlling for related covariates. The sample consisted of N = 565 (...) respondents; 119 were males and 446 were females. Mean age was 35.42, range was 18–77 years. We used convenience sampling to gather the data at the end of March 2020 via social media in Slovakia. The CSS showed good reliability levels and a three-factor structure: Confidence in Institutions, Confidence in Personal and Family Behaviors, and Confidence in Others’ Behaviors. The PRCS showed good reliability levels and a two-factor structure: Fear of Contraction and Perceived Likelihood of Contraction. Participants with higher levels of Confidence in Others’ Behaviors perceived the spread of the coronavirus to be less threatening, both cognitively and affectively. This finding could be used when designing public health policy and emergency communication. Enhancing confidence in others’ behaviors could encourage individual responsibility, social responsibility, and solidarity through social bonds extending beyond the family. In future research we plan to replicate the data collection using the same instruments in different countries so the results are comparable across cultures and can be used to improve emergency communication. SUMMARYThis article examines Anglo–Dutch rivalry in the Banda Islands in the period from 1609 to 1621, with a particular focus on the process of claiming initiated by the Dutch East India Company and English East India Company. Historians have paid little attention to the precise legal justifications employed by these organisations, and how they affected the outcome of events. For both companies, treaties with Asian rulers and peoples were essential in staking out claims to trade and territory. Because so many (...) different parties were involved, individual documents had to serve multiple purposes, both on the ground in the East Indies and at the negotiating tables back in Europe. Whenever a VOC or EIC official presented a treaty to a Bandanese leader, he had to recognise local power structures in the Spice Islands, but also needed to consider his European competitors in the area, his superiors in Batavia or Bantam, and the company directors back in Amsterdam or London. Consequently, the safest and most reliable course of action was to make as many arguments as possible, piling them on top of one another. The result was an inherently messy process of claiming, yet one that was also clearly intelligible to most parties involved, including Asian rulers and peoples. A constantly changing legal suite extended to freedom of trade and navigation, contracts and alliances with native peoples, just war, conquest, actual possession, and the surrender of native sovereignty to European authorities. Following the manuscript's discovery in 1864, scholars have widely assumed that De Jure Praedae was written by the Dutch lawyer Hugo Grotius in the period 1604–1606. Yet the conventional dating fails to consider the materiality of Ms. BPL 917 in Leiden University Library. By analyzing paper supplies, this article throws new light on the date and manner of the manuscript's composition. The watermarks in the paper, the quire divisions and foliation are considered in combination with relevant textual evidence, such as (...) manuscript references to historical events and any allusions to Ms. BPL 917 in Grotius’ letters and other archival sources. This approach has yielded unforeseen results. Yes, Grotius wrote out the original text in 1604/05, as a fair copy of a previously existing work. Yet he did not stop there. Entire folio-pages were crossed out in Ms. BPL 917 and new ones inserted in the following sequence:- in, or shortly before, January 1607, Grotius deleted f. 63v and 67r and inserted f. 64–66- between January 1607 and Nov–Dec. 1608, he deleted f. 7v, 19r, 38v, and 43r-v and inserted f. 8–9, 18, and 39–42- in November–December 1608, he deleted f. 119r–122r and inserted f. 117–118.These revisions were a direct response to the challenges faced by the Dutch East India Company in this period. Its growing empire in Southeast Asia was under threat from the peace and truce negotiations between the States General and Philip III of Spain and Portugal. Grotius’ revisions of Ms. BPL 917, along with chapter twelve's appearance as Mare Liberum in April 1609, justified the continuation of Dutch empire-building in the East Indies, the Twelve Years’ Truce notwithstanding. Grotius’ rights and contract theories made it perfectly acceptable to conclude a peace or truce in Europe, yet persist in colonial warfare beyond the Line . In this respect – the differentiation between ‘the West and the rest’ in international relations – Grotius’ legacy is still with us today. (shrink)

It is unknown whether hospital-based medical professionals in Spain educate patients about advance directives. The objective of this research was to determine the frequency of hospital-based physicians’ and nurses’ engagement in AD discussions in the hospital and which patient populations merit such efforts. A short question-and-answer-based survey of physicians and nurses taking care of inpatients was conducted at a university hospital in Madrid, Spain. In total, 283 surveys were collected from medical professionals, of whom 71 per cent were female, with (...) an average age of thirty-four years. Eighty-four per cent had never educated patients about ADs because of lack of perceived responsibility, time, or general knowledge of ADs. Patient populations that warranted AD discussions included those with terminal illnesses, chronic diseases, and elderly patients. Regarding degree of AD understanding in medical professionals: 57 per cent of medical professionals claimed sufficient general knowledge of ADs, 19 per cent understood particulars regarding AD document creation, and 16 per cent were aware of AD regulatory policies. Engagement in AD discussions was considered important by 83 per cent of medical professionals, with 79 per cent interested in participating in such discussions themselves. The majority of hospital physicians and nurses do not educate their patients about ADs, despite acknowledging their importance. Following the manuscript's discovery in 1864, scholars have widely assumed that De Jure Praedae (Commentary on the Law of Prize and Booty) was written by the Dutch lawyer Hugo Grotius (1583–1645) in the period 1604–1606. Yet the conventional dating fails to consider the materiality of Ms. BPL 917 in Leiden University Library. By analyzing paper supplies, this article throws new light on the date and manner of the manuscript's composition. The watermarks in the paper, the quire divisions and foliation are (...) considered in combination with relevant textual evidence, such as manuscript references to historical events and any allusions to Ms. BPL 917 in Grotius’ letters and other archival sources. This approach has yielded unforeseen results. Yes, Grotius wrote out the original text in 1604/05, as a fair copy of a previously existing work. Yet he did not stop there. Entire folio-pages were crossed out in Ms. BPL 917 and new ones inserted in the following sequence: - in, or shortly before, January 1607, Grotius deleted f. 63v and 67r and inserted f. 64–66 - between January 1607 and Nov–Dec. 1608, he deleted f. 7v, 19r, 38v, and 43r-v and inserted f. 8–9, 18, and 39–42 - in November–December 1608, he deleted f. 119r–122r and inserted f. 117–118. These revisions were a direct response to the challenges faced by the Dutch East India Company (VOC) in this period. Its growing empire in Southeast Asia was under threat from the peace and truce negotiations between the States General and Philip III of Spain and Portugal. Grotius’ revisions of Ms. BPL 917, along with chapter twelve's appearance as Mare Liberum in April 1609, justified the continuation of Dutch empire-building in the East Indies, the Twelve Years’ Truce (1609–1621) notwithstanding. Grotius’ rights and contract theories made it perfectly acceptable to conclude a peace or truce in (Western) Europe, yet persist in colonial warfare beyond the Line (i.e. the Tropic of Cancer). In this respect – the (implicit) differentiation between ‘the West and the rest’ in international relations – Grotius’ legacy is still with us today. (shrink)

ABSTRACT Politics, religion and legal argumentation were inextricably intertwined in the reception of John Selden’s Mare Clausum/The Closed Sea (1635). The work’s writing and printing history is closely tied to Stuart foreign policy, particularly James I’s and Charles I’s attempts to tax the Dutch herring fisheries. Mare Clausum’s immediate impact on European international relations has received little attention from historians so far. It is clear, however, that government authorities in London, The Hague and Venice expected an official reply from Hugo (...) Grotius, author of Mare Liberum/the Free Sea (1609) and Swedish ambassador in Paris. Yet the latter declined to assist the Dutch authorities in this matter, blaming them for his imprisonment in 1618–1621 and his second banishment from Holland in 1632. The antipathy was mutual. The Dutch authorities abhorred Grotius’ pleas for religious tolerance and commissioned his Calvinist kinsman Dirk Graswinckel to respond to Selden instead. Graswinckel had already published Libertas Veneta/venetian Liberty (1634), a learned defense of the Republic of Venice’s political interests. In ‘Vindiciae maris liberi’/vindication of the Free Sea (written 1636–1637), he tried –but arguably failed – to reconcile Dutch claims to freedom of navigation, trade and fishing with Venetian claims to the Adriatic. This article reconstructs the printing history of Hugo Grotius's Mare liberum . It examines the political circumstances which prompted the pamphlet's publication, but then seemed to conspire against it, and relates these to Grotius's revision of chapter 12 of Ms. BPL 917 in Leiden University Library, the one surviving copy of De iure praedae . While preparing chapter 12 for the press, he made a serious effort to tone down its bellicose rhetoric, erasing, for example, all references to the Spanish (...) claims to the Americas. His aim was to placate the French envoy Pierre Jeannin and his own political patron Johan van Oldenbarnevelt, the driving forces behind the negotiations for the Twelve Years' Truce . In the context of these negotiations, Grotius was at pains to downplay his radical rights theories. The subjective right of punishment only received a mention in the conclusion of Mare liberum, for example. Yet a discarded outline for the pamphlet's preface shows that the argument of De iure praedae remained uppermost in his mind, witness the outline's denunciation of the 'poisonings, perfidy and crimes of the Portuguese'. Both De iure praedae and Mare liberum had been commissioned by the Dutch East India Company for the express purpose of influencing political developments in its favour. Yet neither treatise had the impact originally intended by Grotius and the VOC directors. Ironically, these occasional writings became classics of international law instead. (shrink)

Re-Engineering Philosophy for Limited Beings is about new approaches to many of the big topics in philosophy of science today, but with a very different take. To begin with, we are urged to reject the received Cartesian-Laplacean myths: Descartes’ certainty and Laplace’s computational omniscience. Instead, Wimsatt re-engineers a philosophy for human beings with all their cognitive limitations. His approaches find their starting point in the actual practices of scientists themselves, which he strongly identifies with engineering practices as the source of (...) researchers’ solutions for dealing with a complex world. He aims to construct an understanding of scientific methodology around the central role of reduction. But he dismisses eliminative reductionism in favor of a heuristic-based realist view. Wimsatt’s world is a complex one, and this means that science needs to do away with all the absolute and simple answers, because they do not reflect the world we are living in. A complex world requires the mindset and tinkering of an engineer to uncover its reality. The appropriate response must be heuristics all the way down as we constantly seek out reliable inferences on often shifting ground. To this end, we aim for models and theories that are robust, just as engineers aim to build robust machines. And although errors occur and approaches are fallible, they allow us to continually adapt the heuristics applied and sharpen our perceptions so as to develop more refined tools for investigating and understanding the world. Argumentation is considered crucial in numerous disciplines in schools and universities because it constitutes an important proficiency in peoples' daily and professional lives. However, it is unclear whether argumentation is understood and practiced in comparable ways across disciplines. This study consequently examined empirically how students perceive argumentation in science and language lessons. Specifically, we investigated students' beliefs about the relevance of discourse and the role of facts. Data from 3,258 high school students from 85 German secondary schools were analyzed with (...) multigroup multilevel structural equation modeling in order to disentangle whether or not differences in argumentation across disciplines exist and the extent to which variation in students' beliefs can be explained by gender and school track. Results showed that students perceived the role of facts as highly relevant for science lessons, whereas discursive characteristics were considered significantly less important. In turn, discourse played a central role in language lessons, which was believed to require less knowledge of facts. These differences were independent of students' gender. In contrast, school track predicted the differences in beliefs significantly. Our findings lend evidence on the existence of disciplinary school cultures in argumentation that may be the result of differences in teachers' school-track-specific classroom practice and education. Implications in terms of a teacher's role in establishing norms for scientific argumentation as well as the impact of students' beliefs on their learning outcomes are discussed. (shrink)

BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. The SARS-CoV-2 pandemic has highlighted the interdependency of healthcare systems and research organizations on manufacturers and suppliers of personnel protective equipment and the need for well-trained personnel who can react quickly to changing working conditions. Reports on challenges faced by research laboratory workers are rare in contrast to the lived experience of hospital health care workers. We report on experiences gained by RLWs who significantly contributed to combating the pandemic under particularly challenging conditions due to increased workload, sickness and interrupted (...) PPE supply chains. RLWs perform a broad spectrum of work with SARS-CoV-2 such as autopsies, establishment of virus cultures and infection models, development and verification of diagnostics, performance of virus inactivation assays to investigate various antiviral agents including vaccines and evaluation of decontamination technologies in high containment biological laboratories. Performance of autopsies and laboratory work increased substantially during the pandemic and thus led to highly demanding working conditions with working shifts of more than eight hours working in PPE that stressed individual limits and also the ergonomic and safety limits of PPE. We provide detailed insights into the challenges of the stressful daily laboratory routine since the pandemic began, lessons learned, and suggest solutions for better safety based on a case study of a newly established HCBL designed for autopsies and research laboratory work. Reduced personal risk, increased resilience, and stress resistance can be achieved by improved PPE components, better training, redundant safety measures, inculcating a culture of safety, and excellent teamwork.
